TERMS & CONDITIONS
Parties: This agreement is made between the Traveler(s) and Points South LLC (dba BORN TO ROAM TRAVEL COMPANY, herein known as Born to Roam Travel Company).
Role: We serve as a booking agent for trusted suppliers and as a travel advisor who works to serve our clients. Born to Roam Travel Company offers retail travel services which are provided by separate and independent suppliers and operators of travel services to clients. Born to Roam Travel Company does not operate, control, or otherwise provide the services of the independent travel suppliers. The Traveler(s) agree and understand that Born to Roam Travel Company is not responsible for any operating failures, loss, damage, delay, or injury to the Traveler or members of the traveling party, nor for consequential damages, which may result from failure, delays, or injuries, which arise out of or during the scheduled travel. Traveler agrees and understands that Born to Roam Travel Company is not responsible for any damages, direct or consequential, which may arise as a result of acts of God, social or labor unrest, war, political or national strike, terrorist activities, mechanical failures, climatic conditions (including beach conditions), or any other actions or omissions beyond the control of the travel advisor.
Pricing: All rates are per person based on double occupancy, subject to availability at time of booking, and may increase without notice. Non-discountable fees (port charges) are included in pricing unless otherwise stated. Airfare, air taxes, transfers, government fees, and taxes are additional unless otherwise stated. A booking processing fee is additional and subject to change without notice. Ask your agent for details. Information and pricing is subject to change without notice. In the event of a pricing error, or any other misrepresentation or omission, we reserve the right to adjust the pricing or make any other corrections.
Cost of proper identification, documentation, vaccination, health screenings, and/or testing results are solely the responsibility of the Traveler(s).
Documentation: It is the Traveler(s)’s responsibility to determine and provide proper identification, documentation (including passport and visas if required), health screenings, and vaccine records/testing results for the destinations to which they are traveling. The Traveler(s) should verify requirements well in advance of travel to insure compliance. Travelers who do not meet these requirements will be denied boarding by cruise lines and airlines. Born to Roam Travel Company is not responsible for providing documentation, health screenings, and vaccine records/testing results.
Cancellation Policies And Fees: The Traveler(s) understands that once a deposit is made, the contract is now between the Traveler(s) and the travel supplier(s)/travel operator(s). Born to Roam Travel Company does not accept any liability for any changes or costs incurred for the Traveler’s booking(s). The Traveler is responsible for making payments on time and understands that the supplier and/or operator may cancel reservations for failure to make payment. Born to Roam Travel Company accepts no liability for supplier- or operator-canceled reservations. The Traveler(s) understand(s) that if they cancel, they are bound by the supplier's and/or operator’s terms and conditions regarding canceling and refunds. Born to Roam Travel Company is not responsible for a supplier's and/or operator’s failure to pay a refund.
It is the Traveler(s)’s responsibility to know and understand the supplier’s and/or operator's and Born to Roam Travel Company's cancellation penalties. It is advised that the Traveler(s) visit the supplier’s and/or operator's website to view those policies. The policies of Born to Roam Travel Company are set forth as follows: Born to Roam Travel Company is not responsible or liable for any negligent acts or defaults of the supplier(s) and/or operator(s) or anyone else not under our control. Should the Traveler(s) wish to cancel their travel plans, their right to a refund is limited by the supplier’s and/or operator's terms and Born to Roam Travel Company's policies. The supplier(s) and/or operator(s) and Born to Roam Travel Company may change their cancellation policies at any time. Cancellations are subject to the protection of agency revenue.
Travel Insurance: The purchase of travel insurance that protects you against potential losses is highly recommended. It can be purchased from various suppliers at the time travel arrangements are made. Please review the coverage and policies carefully. It is the responsibility of the Traveler(s) to purchase coverage directly from the travel insurance supplier. If additional quotes for travel insurance are desired, please contact your agent. Certain coverage is available for a limited period after deposit of a booking.
Travel Documents: Traveler(s) will receive travel documents approximately 1-2 weeks prior to the departure date. Upon receipt of tickets and any and all documents, it is the sole responsibility of the Traveler(s) to review and verify all information. Contact Born to Roam Travel Company immediately if changes or corrections are required. Any costs incurred for incorrect information are the responsibility of the Traveler(s) after the receipt of travel documents (electronic or otherwise).
If traveling with a minor, it is the Traveler(s)’s responsibility to acquire and provide the necessary documents to travel with said minor.
It is the responsibility of the Traveler(s) to know and understand the restrictions for entry to the destinations in the itinerary and abide by those regulations. Born to Roam Travel Company does not have any authority to admit or deny a Traveler entry aboard an aircraft or ship or to a destination.
Liability Limits: Born to Roam Travel Company acts as an agent for travel suppliers and operators. We are not the source, provider, or operator of travel products. Born to Roam Travel Company, therefore, shall not be responsible for breach of contract or any intentional or careless actions or omissions on the part of such travel suppliers and/or operators, which result in any loss, damage, delay, or injury to you, your travel companion(s) or group members. Born to Roam Travel Company shall not be responsible for any injuries, damages, or losses caused to any Traveler. By embarking on their travel, the Traveler voluntarily assumes all risk involved with such travel, whether expected or unexpected.
Elements of this website are protected by copyright, trade dress, and other laws and may not be copied or imitated whole or in part. No logo, graphic, sound, image, or html coding from this website may be copied, altered, or retransmitted unless expressly permitted by Born to Roam Travel Company.
Born to Roam Travel Company makes no representations about the suitability of the information contained in the pages and related graphics published on this website for any purpose. such documents are provided "as is" without warranty of any kind. Born to Roam Travel Company hereby disclaims all warranties and conditions with regard to this information, including all implied warranties and conditions of merchantability fitness, a particular purpose, title, and non-infringement. Under no circumstance shall Born to Roam Travel Company be liable for any special, indirect, or consequential damages whatsoever resulting from the loss of use, data or profits, whether in an action in contract or an act of tort, arising out of or in connection with the use or performance of information available from this website.

Born to Roam Travel Company shall not be responsible for damages or losses incurred by any user as a result of such user's use of, or reliance of, such third party materials.
General Limitation of Liability: In no event shall Born to Roam Travel Company including its owners, agents, representatives, affiliates, or providers (collectively, the "covered parties"), be liable for any injury, death, loss, claim, damage, act of god, accident, delay, or any special, exemplary, punitive, incidental or consequential damages of any kind, whether based in contract, tort or otherwise, which arise out of or are in any way connected with any use of this site or with any delay or inability to use this site, or for any information, software, products or services obtained through this site or sites used by the agency, even if Born to Roam Travel Company has been advised of the possibility of such damages.
In addition, Born to Roam Travel Company and covered parties accept no responsibilities for any damage and/or delay due to supplier/operator cancellations, shortages, sickness, pilferage, labor disputes, machinery breakdown, quarantine, government restraints, weather, or causes beyond the covered parties' control. No responsibility is accepted for any additional expense, omissions, delays, re-routing, or acts of any governmental authority. No covered party shall be responsible for any supplier and/or operator breach of any warranty including, but not limited to, implied warranties of fitness for a particular purpose or of merchantability, nor shall any covered party be responsible for any other wrongdoing of a supplier/operator (including any liability in tort), as to any products and/or services available through this site. No covered party shall be responsible for any supplier/operator's failure to comply with these terms and conditions nor for any supplier/operator's failure to comply with applicable federal, state, and local law including, without limitation, laws governing the sale, warranty, and return of perishables.
If, notwithstanding the above, a covered party is found liable for any loss or damage relating to the use of this site, user agrees the liability of any such party shall in no event exceed the fees charged to the user assessed by Born to Roam Travel Company for making a purchase.
